Refugee Appeal

Personal advice. A strategy built around your circumstances.

What it is

If the Refugee Protection Division refuses your claim, you may be able to appeal to the Refugee Appeal Division. Appeals are usually decided on paper, based on whether the first decision was wrong. As an RCIC-IRB, I can represent you.

Who is eligible

  • Most refused claimants
  • Not claims found manifestly unfounded or to have no credible basis, or certain claims made at the Canada-US land border
  • A notice of appeal filed within 15 days of receiving the written reasons, and the full appeal within 30 days

New evidence is allowed only if it arose after the decision or wasn't reasonably available before. If the appeal fails, judicial review at the Federal Court may still be possible through an immigration lawyer.
