Refugee Claims

Personal advice. A strategy built around your circumstances.

What it is

A refugee claim asks Canada for protection because returning home would expose you to persecution, torture or a serious risk to your life. Eligible claims go to a hearing at the Refugee Protection Division of the Immigration and Refugee Board, where the outcome usually turns on credibility and evidence. As an RCIC-IRB, I can represent you at the hearing.

Who is eligible

  • You meet the definition of a Convention refugee or a person in need of protection
  • You claim at a port of entry or online from inside Canada
  • For claims made at the border, the Basis of Claim form is due within 15 days

Claims are generally ineligible for a hearing if you first entered Canada after June 24, 2020 and claimed more than one year after that first entry, or if you crossed the Canada-US land border between official crossings and waited more than 14 days. Ineligible claimants are usually directed to a pre-removal risk assessment instead.
