COMPLEX IMMIGRATION CASES
Inadmissibility Hearing
Personal advice. A strategy built around your circumstances.
What it is
When the Canada Border Services Agency alleges that someone can't enter or stay in Canada, the case can go to an admissibility hearing at the Immigration Division of the Immigration and Refugee Board. The member decides whether the allegation is proven. As an RCIC-IRB, I can represent you.
When it applies
Permanent residents and foreign nationals facing allegations such as:
- Criminality or serious criminality
- Misrepresentation
- Breaching the conditions of their status
- Security or organized crime concerns
A finding of inadmissibility can lead to a removal order, and some permanent residents can appeal it to the Immigration Appeal Division. If you are detained, a detention review is held within 48 hours, again within seven days, then every 30 days.
