COMPLEX IMMIGRATION CASES

Humanitarian and Compassionate (H&C)

Personal advice. A strategy built around your circumstances.

What it is

A humanitarian and compassionate application asks IRCC to grant permanent residence on exceptional grounds when you don't fit a regular program. It is discretionary and suited to genuinely exceptional circumstances.

Who is eligible

Officers weigh:

  • How established you are in Canada through work, community, family and time here
  • The best interests of any children affected
  • The hardship you would face if you had to leave
  • Your family ties in Canada

After a refused refugee claim, you generally must wait one year before applying, with exceptions for children and serious health risks. Only one H&C application can be in process at a time, and applying does not, on its own, stop or delay a removal.
