REFUSALS & SECOND OPINIONS

Refusal and Appeals

Personal advice. A strategy built around your circumstances.

What it is

A refusal letter rarely shows the officer's full reasoning. The right next step, whether a new application, a reconsideration request, an appeal or a court challenge, depends on what the officer actually concluded.

Your options

  • New application: for visitor, study and work refusals, which have no formal appeal
  • GCMS notes: the officer's internal notes, requested through access to information, which show the real reasons
  • Reconsideration: a request for the officer to look again where there was a clear error
  • Immigration Appeal Division: for refused family sponsorships, residency obligation decisions and some removal orders, usually within 30 days
  • Judicial review: at the Federal Court, through an immigration lawyer, within 15 days of a decision made in Canada or 60 days for one made outside Canada

A reconsideration request doesn't stop the court deadline. As an RCIC-IRB, I can represent you at the Immigration Appeal Division.
